Advisory opinion request regarding whether the Code of Governmental Ethics ("Ethics Code") would prohibit a Fist Assistant District Attorney from also being employed as an administrative law judge.
Facts:
Monica Doss is a First Assistant District Attorney with the District Attorney's Office for the 9th Judicial District. She is requesting an opinion as to whether the Louisiana Dual Officeholding and Dual Employment laws prohibit her from also serving as an administrative law judge on a part-time contractual basis.
Law:
La. R.S. 42:1111A prohibits a public employee from receiving anything of economic value, other than compensation and benefits from the governmental entity to which he is duly entitled, for the performance of the duties and responsibilities of his office or position.
Recommendations:
Adopt proposed advisory opinion.
