Request that the Board waive the $3,000 campaign finance late fee assessed against Movement for Change, Inc., a political action committee, its chairperson, Tyra L. Banks, and its treasurer, Brock A.M. Facione, in the October 12, 2019 election, whose 10-G campaign finance disclosure reports was filed 870 days late. |

James C. Donohue, on behalf of the committee, requests a waiver and states the following:
A 48-hour report was timely filed on October 2, 2019, reflecting all contributions and all expenditures received and/or incurred by the PAC in connection with the primary election. No other expenditures or contributions were incurred or received after the filing of the 48-hour report. We realize now this was in fact a mistake on our part and that a 10-G should have been filed reflecting the same identical financial information as the previous 48 report. However, we would like to note that the mistake was in "good faith" and did not result in the failure to disclose any financial information not previously reported. Upon receipt of late fee, they promptly filed the 10-G. There was never any intention by Movement for Change to attempt to avoid full disclosure and reporting of any and all expenditures and contributions.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty as provided in R.S.42:1157 for each day until such report is filed.
