RE:
Advisory Opinion request from John James Clark, President of Amite River Basin Commission ("ARBC"), as to whether he may be employed by ARBC as its Executive Director.
Facts:
Mr. Clark is currently a board member designee of the Amite River Basin Commission ("ARBC") on behalf of the Iberville Parish President. He also currently serves as the President of ARBC.
ARBC is considering hiring an individual to serve as Executive Director.
Law:
La. R.S. 42:1121A(2) provides that no former member of a board or commission shall, for a period of two years following the termination of his public service on such board or commission, contract with, be employed in any capacity by, or be appointed to any position by that board or commission.
La. R.S. 42:1113B prohibits an appointed member of any board or commission, member of his immediate family, or a legal entity in which he has a substantial economic interest, from bidding on or entering into or being in any way interested in any contract, subcontract, or other transaction which is under the supervision or jurisdiction of the agency of such appointed member.
La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.
La. R.S. 42:1102(23) defines "transaction involving the governmental entity" to mean any proceeding, application, submission, request for a ruling or other determination, contract, claim, case, or other such particular matter which the public servant or former public servant of the governmental entity in question knows or should know: (a) Is, or will be, the subject of action by the governmental entity. (b) Is one to which the governmental entity is or will be a party. (c) Is one in which the governmental entity has a direct interest.
Recommendations:
Adopt proposed advisory opinion.
