Waiver request submitted by Daniel Moore, Constable / District 1 / Webster Parish, regarding a $500 late fee assessed for filing his 2020 Tier 3 annual pfd 422 days late.
Facts:
Daniel Carl Moore did not know how to fill out his disclosure originally due 5/17/2021, which was due to a lack of knowledge. He is requesting a waiver of the fee because he is not a wealthy man and has 4 kinds with his wife. He states that his reason for not filing was not due to laziness or ignoring his responsibilities, but that he didn't know the process to file a disclosure of a waiver request. On Mr. Moore's behalf, his wife Jennifer Moore notes that the ballot was completed by someone who asked him to run for office and he didn't campaign at all. He merely wanted to help his community. Ms. Moore states that her husband is a plumber and does not work with computers. This is a reason he has trouble filing. She was informed of her husband's options in 2021 after he became delinquent. Ms. Moore faxed the completed paperwork to BOE, but it was not received. Ms. Moore does not know of any other options to rectify the situation, so they both asking for a waiver of the assessed late fee.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
