Waiver request submitted by Mark Manda, former member of the Florida Parishes Juvenile Justice Commission, regarding a $1500 late fee assessed for filing his 2020 Tier 2.1 annual pfd 416 days late.
Facts:
On 2/9/2023, Mark Manda received a notice stating that he owed a $1,500 fee. The notice further states that he received a delinquency notice on 12/9/2021, but he is insisting that he did not receive nor sign for a letter. While speaking with a BOE representative, it was verified that the notice had not been signed by him and instead a mail carrier signed it. Upon receipt of the most recent letter, he immediately completed and submitted the disclosure. Mr. Manda takes pride in handling all of his professional responsibilities on time. The years 2020-2021 were tough with COVID and meetings for the Board he served on were sporadic and he found himself unable to attend due to work and personal matters. It was later decided that he should resign, which was done on 4/23/2021. Mr. Manda notes that he is not making excuses, but merely asking for leniency in being granted this one-time waiver. He hopes that his actions immediately following receipt of the referenced letter demonstrates his sense of urgency in complying and appreciates the consideration of his request.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
