Waiver request submitted by Todd Gerald Chiasson, Louisiana Energy and Power Authority, regarding a $1500 late fee assessed for filing his 2020 Tier 2.1 annual pfd 317 days late.
Facts:
Todd Gerard Chiasson retired in June of 2021 and at that time was no longer on the LEPA Board as an alternate board member. The first few months of 2021 were stressful while being in the process to retire and train someone to replace him. He was also trying to line up a job after retirement since he would not be able to financially support himself with his retirement pay. He forgot to file his PFD for the year 2020. He spoke with a BOE representative and was notified that his wife signed for the notice. His wife does not recall receiving the notice. Somehow it was misplaced or thrown away by mistake. Mr. Chiasson states that he would have responded immediately had he received it. He has since completed the disclosures for 2020 and 2021. He hopes that you will find it in your heart to waive the late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
