Waiver request submitted by Jacob Dustin "Jake" Halley, former member of the Bayou D'Arbonne Lake Watershed District, regarding a $1500 late fee assessed for filing his 2019 Tier 2.1 annual pfd 658 days late.
Facts:
Jacob "Jake" Halley is no longer associated with the Bayou D'Arbonne Watershed District Commission (BDWDC) in any capacity. When he ran for public office in 2019 he believed that he was not required to file the 2.1 disclosure separately if he included the information associated with his service at BDWDC. He has since been made aware of his error. After speaking with a BOE representative, he believed the issue had been resolved. Although the notice received 4/2022 shows as "received", Mr. Halley does not recall that specific letter. He sold his home located in Farmerville, LA, and was living with family in Calhoun, LA. Most of his mail was not forwarded to the new address. Mr. Halley is currently set up for payment arrangements with CF for the year 2019. He is not financially able to pay additional fines and is asking that the late fee be waived to avoid any further financial hardship.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
