Waiver request submitted by Edward "Ted" C. James, II, former Representative / District 101, regarding a $1000 late fee assessed for filing his 2020 Tier 2 annual pfd 10 days late.
Facts:
On 11/11/2011, Edward "Ted" James was elected to the House of Representatives, State Representative for District 101,where he remained for ten years until he resigned on 1/29/2022. He has always taken pride in honoring his obligations during his tenure as an elected official. He received the notice requiring him to file by 4/19/2022 but failed to file until 4/29/2022. Given the time between April 2022 and now, it is difficult for him to pinpoint what was going on at that time. However, after reviewing his calendar it reflects that on 4/19/2022 he had a court date. Additionally, he traveled to Houston on 4/11/2022 for a speaking engagement and later that day to Orlando for the National Hurricane Conference for several days, returning shortly before 4/15/2022. Presumably, at some point thereafter, he received the delinquency notice and immediately filed the statement. During that time he had a new job overseeing ten SBA offices, in five different states, traveling 2-3 days weekly. For these reasons, he respectfully asks for a waiver of the$1000 late fee.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
