Waiver request submitted by Gayle D. Fisher, former member of the Workforce Development Board, Second Planning District / Area #20, regarding a $ 1500 late fee assessed for filing her 2018 Tier 2.1 annual pfd 1119 days late.
Facts:
Gayle Fisher's term on the LA Workforce Investment Board 20 ended on 6/30/2018.She wasn't aware a final report would be due nor did the LWDA 20 WIB Board advise her to do so. She relocated out of the LA Workforce location at 1721 S. Burnside, Gonzales, LA in July 2018. She never received any forwarded notices or was told about said notices. This particular location was closed on 9/30/2019. She has attached a certified green card signed by someone else dated 1/8/2020. Had she received anything she would have responded immediately. Her previous reports were filed on time. Ms. Fisher is a state employee placed on the board to represent the LA Workforce Commission as part of the requirements of the WIOA Program. Financially, she is unable to pay and is asking for a waiver of the assessed late fee. She has worked for this state for 55 years and is a dedicated employee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
