Waiver request submitted by Olivia S. Regard, Louisiana State Arts Council, regarding a $1500 late fee assessed for filing her 2020 Tier 2.1 annual pfd 393 days late.
Facts:
Olivia Regard's 2020 disclosure was due during the early days of the COVID-19 pandemic and her life had been upended. She was working from home and helping her children navigate school from home. In addition, during the pandemic, she moved into her newly purchased home. With the additional burdens, she neglected to file her disclosure. She has since submitted her 2020 statement and all other required filings for 2021 and 2022. Ms. Regard enjoys her service on the State Arts Council and was recently recommissioned in October 2022 by Governor Edwards to serve a second three-year term. Serving on this board in addition to the Board of Directors for the Acadiana Center for Arts has made Louisiana a unique place to work, live, and raise her family. Ms. Regard would like to ask that you reconsider the late fee assessment, given the circumstances leading to her omission and waive the fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
