Waiver request submitted by Fredman Hardy, Jr., former member of the Calcasieu Parish School Board / District 2, regarding a $2500 late fee assessed for filing his 2021 Tier 2 annual pfd 151 days late.
Facts:
Mr. Fredman Hardy Jr. states that during the hurricanes Laura and Delta, he evacuated to Baton Rouge, LA, Houston, TX, and Orange TX. Hurricane Laura was on 8/7/2020 and Hurricane Delta was approximately a month later. He returned to his home, but he had to move for repairs while he resided in a hotel from 2/2022-9/2022.This was the time period of 1/1/2022 -5/15/2022 when he was obligated to file his disclosures. During this time, his furniture and records were placed in storage bins by movers and he was unable to retrieve his W-2 records, but he completed his federal and state taxes. During this reporting period, he was responsible for transporting his son to and from cancer treatments, the MD Anderson Hospital, and Lake Charles Memorial Hospital. He passed away on 7/19/2022. Unfortunately, he is unable to locate the W-2s or his son's medical records. Mr. Hardy notes that additional issues such as flooding, ice storms, COVID concerns, delays in sending and receiving mail, the decision not to campaign, and prolonged insurance company reimbursements played a part in his late filing. He would like to ask for a waiver of this late fee that he cannot afford.

Law:
La. R.S. 42:1124.2 requires each person holding a public office who represents a voting district having a population of 5,000 or more persons to file an annual personal financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.

Recommendations:
Suspend all based on future compliance with the Code of Ethics.
