Waiver request submitted by Lennis Smith Elston, Caddo Parish Fire Protection District 5, regarding a $1500 late fee assessed for filing his amended 2019 Tier 2.1 annual pfd 435 days late.
Facts:
Lennis S. Elston states that his office received the late fee assessment. The missing information was unknown to him at the time of posting the 2019 disclosure. Schedule E requests information on income from the State, political subdivisions, and/or gaming interest, but he has never worked for any of these types of entities. Upon the death of his cousin, he inherited her retirement account. He was named beneficiary and the name appears on his direct deposit only as Teachers Retirement System. His cousin was a librarian; not a teacher. He later realized that the full name of the entity paying out that inherited retirement account is the Teachers Retirement System of Louisiana. Even after receiving the notice, Mr. Elston did not think it was a state entity. He believed it was an investment group. It was not his intention to exclude this information. He has since corrected the misfiling and would like to request a late fee waiver.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
