Waiver request submitted by LaShonda Michele Watts, former member of the Board of Examiners for Nursing Facility Administrators, regarding a $1500 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 362 days late.
Facts:
On 12/15/2022, LaShonda M. Watts received a certified letter in reference to her assessed late fee in the amount of $1500. On 12/13/2021, she received a Notice of Delinquency-Amend form. She spoke with a Louisiana Board of Ethics representative and was informed there was required information omitted from the Schedule E and was instructed to fax the corrected section.

On 12/15/2022, Ms. Watts received a certified letter dated 12/10/2022 LFO. She then attempted to contact BOE and left a voicemail. She received a callback on 12/16/2022 and was told to send the confirmation page that was originally faxed on 12/13/2021. Shortly after, she was contacted and notified that the confirmation page had been received. Ms. Watts was told that the IT Department would look for the original fax, but the statement was not found. Since Ms. Watts received the confirmation receipt page she assumed her disclosure was submitted. She is graciously asking to have the entire fee waived.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
