Request that the Board waive the $1,300 campaign finance late fee assessed against Lambert C. Boissiere, Jr., a successful candidate for Constable, 1st City Court, Orleans Parish, in the November 3, 2020 election, whose 2022 Supplemental campaign finance disclosure report was filed 13 days late.
Facts:
Lambert C. Boissiere, Jr requests a waiver and states the following: That his report was completed on 1/24/2023 and confirmed by a BOE representative. He was told that it showed the report was completed on that day, but he inadvertently did not hit the submit button. Mr. Boissiere's preparer, Bridget Joseph, believed she submitted the report and received an approval number. The approval number was for the Statement of Organization report filed prior. It was Ms. Joseph's unintentional error and misjudgment of the submit button not being pressed. Mr. Boissiere would like to kindly ask for a waiver of the late fee or that the fine be reduced. All previous filings for this campaign have been on time.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $1,000 based on Rule 1205C; decline to waive.
