RE:
Advisory Opinion request from Sherry Lassere, Assistant to the Executive Counsel for the Governor's Office, regarding her participation in matters involving the HIV/AIDS Alliance for Region Two ("HAART").
Facts:
Sherry Lassere is employed by the State of Louisiana in the Governor's Office. She is an assistant to the Governor's Executive Counsel.



Ms. Lassere serves on the Board of the HIV/AIDS Alliance for Region Two ("HAART") which is a 501(c)(3) non-profit organization that offers a broad continuum of services to people living with HIV in the Baton Rouge area. HAART operates the Open Health Care Clinic, which provides assistance to people living with HIV, including housing, primary care, medication assistance, case management, and supportive services. Ms. Lassere has no ownership interest in HAART and receives no compensation for her services as a board member.



The Open Health Care Clinic is seeking capital outlay funding from the State of Louisiana. Ms. Lassere asks whether she is allowed to participate in the meetings to discuss the funding requests.


Law:
La. R.S. 42:1112(B)(3): No public servant, except as provided in R.S. 42:1120, shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest: any person of which he is an officer, director, trustee, partner, or employee.

EXCEPTION:

La. R.S. 42:1123(1): Participation in the affairs of charitable, religious, nonprofit educational, public service, or civic organizations, bona fide organized public volunteer fire departments when no compensation is received, or the activities of political parties not proscribed by law.

Recommendations:
Adopt the proposed advisory opinion.
