Request for an advisory opinion regarding whether the Code of Governmental
Ethics ("Code") permits Troy Abshire to serve on the Advisory Board for the Down Syndrome Association of Acadiana
while serving as Director of Developmental Disabilities for an Local Governmental Entity (LGE). |

Troy Abshire currently serves as the Director of Developmental Disabilities for the Acadiana Area
Human Services District ("AAHSD"). AAHSD is a Local Government Entity ("LGE")
that serves seven parishes and provides support and services to families and individuals
that have been determined to have a developmental disability.
The Down Syndrome Association of Acadiana (the "Association") has asked Mr. Abshire to be a part
of its Advisory Board. The Association is a 501 (c)(3) non-profit
education and parent support group for families and professions serving those
families in the Acadiana area. The Association is governed by a Board of
Directors that is comprised of parents, siblings, family, and professionals who
deeply care for individuals with Down Syndrome. The purpose is to promote
the interests of persons with Down Syndrome and their families through
advocacy, public awareness and information covering all aspects of Down Syndrome. The Association provides families with a support network,
sharing experiences from the pre-birth of a child throughout the states of
education and adult living within the community.
As a member
of the Advisory Board, Mr. Abshire would attend an annual meeting to contribute input,
ideas and suggestions aimed at fostering the Association's growth and enhancing
its support for families in the community. He would
not be compensated for his position on the Advisory Board.
The
Association has no agreements or contracts with AAHSD. AAHSD has no direct
relationship with the Association, other than providing information about
support and services for people with developmental disabilities.

La. R.S. 42:1111(C)(2)(d). No public servant and no legal entity in which the public servant exercises control or owns an interest in excess of twenty-five percent, shall receive any thing of economic value for or in consideration of services rendered, or to be rendered, to or for any person during his public service unless such services are:
(d) Neither performed for nor compensated by any person from whom such public servant would be prohibited by R.S. 42:1115(A)(1) or (B) from receiving a gift.
