Waiver request submitted by Hilda Borel Edmond, former member of the Lafayette Parish Public Library Board of Control, regarding a $1500 late fee assessed for filing her 2020 Tier 2.1 annual pfd 386 days late.
Facts:
Hilda Edmond submitted her W-2 and 1099 forms and later realized they weren't acceptable requirements. After being contacted on 2/7/2023, she faxed the requested statements, but all the pages did not go through, so she resubmitted the form. She received a NOD requesting that the 2020 and 2021 statements be resubmitted. She complied, but Schedule E was incomplete and she received a notice dated 5/12/2023 requiring her to amend. She contacted BOE and waited a return call and later was unable to reach the office due to her mother being hospitalized. On 5/22/2023, she received clarification and was instructed on how and what needed to be resubmitted. It was confirmed as received and correct. Ms. Edmond made every effort to comply but had a few mishaps along the way. She would like to humbly ask that you waive the assessed late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance.
