Advisory Opinion request regarding whether the Code of Governmental Ethics ("Code") permits Randall Fillmore to accept a position with Magellan Health and support the Louisiana Pharmacy Benefits Manager implementation post his public employment.
Facts:
Randall Fillmore currently performs work for the Louisiana Department of Health ("LDH") pursuant to a Medicaid Technical Services contract with the University of New Orleans ("UNO"). He is compensated by UNO for the work he does for LDH. At UNO, Mr. Fillmore reports directly to Danny Murnane at UNO, who serves as the Assistant Director of the Medicaid Technical Services contract.

Mr. Fillmore currently provide services to the Medicaid Enterprise Systems section ("MES") of LDH, supporting various initiatives including the Pharmacy Benefits Manager implementation ("PBM"). At LDH, Mr. Fillmore reports to Jacques Kado, the Medicaid Program Manager.

During the course of the PBM implementation, Mr. Fillmore was offered a position with a PBM vendor, Magellan Health. In the position with Magellan Health, Mr. Fillmore would be supporting the Louisiana PBM implementation. Magellan Health is also implementing their PBM services in other states. Mr. Fillmore stated that there could also be a future job offer to support a Magellan Health PBM implementation in another state, should Magellan Health be awarded the contract.

Law:
La. R.S. 42:1121B provides that no former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
Recommendations:
Adopt the proposed advisory opinion.
