RE:
Request that the Board waive the $1,320 campaign finance late fee assessed against Jessie Bellard, a successful candidate for St. Landry Parish President in the March 20, 2021 election and his committee's chairperson, Brandie Bellard, and treasurer, Danian L. Herpin whose 2022 Supplemental campaign finance disclosure report was filed 22 days late.
Facts:
Jessie Bellard requests a waiver and states the following: He would like to apologize for the oversight of filing his 2022 Supplemental timely and notes that he takes pride in complying at all times. Unfortunately, he was unaware that the report was due in conjunction with the annual report. Mr. Bellard was not informed of any outstanding reports when the annual was filed. Although he is aware of his responsibility to stay informed, he was notified after the report was 22 days late. Considering the previous track record of timely and accurate reporting, he would like to kindly ask that you waive the late fee. Mr. Ballard assures that immediate corrective measures have been taken to ensure that all future reports will be submitted timely.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
