RE:
Advisory Opinion request from Steve Link, member of Livingston Parish School Board, as to whether his wife may be employed by the school board.
Facts:
Mr. Link is a member of the Livingston Parish School Board (the "School Board"), having been elected in the November 8, 2022 election. His wife, Michele Link, is a retired certified teacher.
Ms. Link is interested in being hired by the School Board as a part-time tutor.
Law:
La. R.S. 42:1119A states that no member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1119B(2)(a)(i) permits the school board to employ an immediate family member of a school board member and the superintendent, as a classroom teacher provided the family member is certified to teach or is temporarily authorized to teach while pursuing certification.
La. R.S. 42:1102(3) defines "agency head" to mean the chief executive or administrative officer of an agency or any member of a board or commission who exercises supervision over the agency.
La. R.S. 42:1102(13) defines "immediate family" as the term relates to a public servant to mean his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.
Recommendations:
Adopt proposed advisory opinion.
