A Request for Advisory Opinion, submitted by the City of Kenner City Attorney Michael J. Power, concerning whether the Louisiana Code of Governmental Ethics ("Code") prohibits Michael K. Glaser, Jr. from serving as a Kenner Police Officer while his father is the Mayor of Kenner.
Facts:
Mr. Glaser Jr. was hired as a police officer for the City of Kenner, on April 28, 2023, by elected Police Chief Keith A. Conley. Mr. Glaser Jr.'s father, Mr. Glaser, is the Mayor. The Kenner Charter, Section 5.12, states that, "The Chief of Police is charged with the responsibility of employing and terminating all officers and employees of the Police Department." The Chief of Police is an elected position.
Law:
La. R.S. 42:1102(2)(a)(i) defines "agency" to mean a department, office, division, agency, commission, board, committee, or other organizational unit of a governmental entity.
La. R.S. 42:1119(A) states that no member of the immediate family of an agency head shall be employed in his agency.
Recommendations:
Adopt the proposed advisory opinion.
