A Request for an Advisory Opinion, submitted by Courtney Brown, concerning whether the Louisiana Code of Governmental Ethics ("Code") prohibits her company, Fresh Fridge Vending, from contracting with her employer, KIPP New Orleans.
Facts:
KIPP New Orleans is a charter school organization, where Ms. Brown is an employee. She is also the owner of Fresh Fridge Vending ("FFV"). She inquired as to whether FFV can contract with KIPP New Orleans, to provide food services for the break room at KIPP New Orleans. The proposed contract would involve placing a vending machine in the break room, which would solely serve KIPP New Orleans employees and guests.
Law:
La. R.S. 42:1113(A)(1)(a) states no public servant, excluding any legislator and any appointed member of any board of commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.

Recommendations:
Adopt the proposed advisory opinion.
