Waiver request submitted by Maria C. Guilott, former member of the Harbor Center, regarding a $1500 late fee assessed for filing her 2020 Tier 2.1 annual pfd 446 days late.
Facts:
Maria C. Guilott failed to file the 2020 disclosure because her husband had cancer and they were spending time in Houston at MD Anderson for her husband's treatments. They also had to drive back and forth to Slidell where he received infusions at the Cancer Center. COVID also played a part since they were confined to their home when they were not traveling. Her world was turned upside down when she received the notice in 2022 and failed to submit it. Ms. Guilott's husband had brain surgery in June 2021 and passed in July 2021. After 55 years of marriage, her loss was overwhelming and she was lost without him. Unfortunately, the paperwork she was supposed to submit was lost in the shuffle. Ms. Guilott would like to ask that you waive the fees. *Emailed waiver request submitted on 4/18/23 states surgery was in May 2021. Supporting documents received on 6/9/23 states surgery was 6/18/21.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
