RE:
Request that the Board waive the $240.00 and $600.00 campaign finance late fees assessed against Mindy Ashmore Slaughter, an unsuccessful candidate for Councilman, District 4, City of Zachary (Pop. 20,007) in the November 8, 2022 election, whose 10-P and 10-G campaign finance disclosure reports were filed 6 and 15 days late, respectively.
Facts:
Mindy Ashmore Slaughter requests a waiver and states the following:


This was her first pursuit in the procurement of an elected position. Prior to this election, she served as a Commissioner for the City of Zachary and completed multiple online trainings. Due to the potential conflicts of interest, she decided to fund her campaign herself. There were no additional purchases or expenses so she did not believe she needed to file the 10-P. She realizes she did not make the required percentage of votes to qualify for the run-off, so she failed to file the 10-G from ignorance of protocol. Ms. Slaughter has always committed to upholding ethical conduct and it was an unintentional oversight. She would like to kindly ask for a waiver of the assessed late fee.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to 10-P, decline to waive.

With respect to 10-G, reduce to $400 based on Rule 1205C; decline to waive.
