Advisory Opinion request from Annick Mauroner, former employee of the State of Louisiana, Office of Community Development, regarding post-employment restrictions.
Facts:
Annick Mauroner was employed by the Louisiana Office of Community Development ("OCD") as a Housing Specialist from May 2017 to August 2021. Ms. Mauroner participated in the 2016 Restore LA Program, which was focused on recovery from the floods of 2016. In August of 2021, she was promoted to Resiliency Manager over the Housing and Resiliency Team. In this role, she reported to the Housing Director, with her duties focused on Resettlement and Statewide Buyout Programs. Ms. Mauroner resigned from her employment with OCD in February 2022.
Ms. Mauroner is now employed as a consultant with Hunt, Guillot & Associates, LLC ("HGA") in Baton Rouge, which provides project management and engineering services to clients. She asks whether she can provide consulting services to OCD, through her employment with HGA, on the 2020-2021 Restore LA Program, which was developed in November of 2021 in response to damages caused by Hurricane Laura, Hurricane Delta, Hurricane Ida, and the storms of May 2021. Ms. Mauroner stated that she did not perform any duties on this specific project while employed by OCD.
Law:
La. R.S. 42:1121(B): No former public employee shall, for a period of two years following the termination of his public employment, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction in which such former public employee participated at any time during his public employment and involving the governmental entity by which he was formerly employed, or for a period of two years following termination of his public employment, render, any service which such former public employee had rendered to the agency during the term of his public employment on a contractual basis, regardless of the parties to the contract, to, for, or on behalf of the agency with which he was formerly employed.
La. R.S. 42:1102(2)(a)(i) defines "agency" for public servants in one of the twenty principal departments of the executive branch to mean the office in which such public servant carries out his primary responsibilities.
La. R.S. 42:1102(12) defines "governmental entity" to mean the State or any political subdivision which employed the former public employee.
La. R.S. 42:1102(16) defines "Person" to mean in individual or legal entity other than a governmental entity, or an agency thereof.
Recommendations:
Adopt the proposed advisory opinion.
