Advisory Opinion Request from Wesley Bishop, former Legislator, and currently employee of the New Orleans City Council, regarding post-employment restrictions involving the Legislature.
Facts:
Wesley Bishop previously served in the Louisiana Legislature as an elected State Representative, District 99 from 2011 - 2016. Mr. Bishop also served as an elected State Senator from 2016 until the end of his term in January 2020.
Mr. Bishop is currently employed as the Director of Policy & Government Affairs for New Orleans City Council Member Oliver Thomas, District E. Mr. Bishop is considering providing private consulting and lobbying services to private businesses. He intends to lobby before the Louisiana Legislature and various state agencies. Mr. Bishop asks whether the Code would prohibit him from providing such lobbying services.
Law:
La. R.S. 42:1121(A)(1):No former agency head or elected official shall, for a period of two years following the termination of his public service as the head of such agency or as an elected public official serving in such agency, assist another person, for compensation, in a transaction, or in an appearance in connection with a transaction, involving that agency or render any service on a contractual basis to or for such agency.
La. R.S. 42:1102(2)(A)(iv) defines "agency" for public servants in the legislative branch of state government, to mean the legislative branch in the case of legislators.
La. R.S. 42:1102(9) defines "elected official" to mean any person holding an office in a governmental entity which is filled by the vote of the appropriate electorate.
Recommendations:
Adopt the proposed advisory opinion.
