Advisory Opinion request regarding Damon Mitchell, reserve officer for the Bogalusa Police Department, performing camera repair services on the Police Department's camera system.
Facts:
Damon Mitchell is a part-time reserve officer of the Bogalusa Police Department Mr. Mitchell performs police officer duties and reports to the shift commander-on-duty the days that he serves as a reserve officer. Mr. Mitchell is supplied with a 1099 form at the end of the year for his services as a reserve officer.
The Bogalusa Police Department's camera system needs regular maintenance and occasional service. Mr. Mitchell operates a business involving the management and installation of surveillance cameras. Warden Miller asks whether Mr. Mitchell can contract with the Bogalusa Police Department to provide repair and maintenance services on the camera system at the police department.
Law:
La. R.S. 42:1113A.(1)(a). No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed Advisory Opinion.
