Advisory opinion request concerning the propriety of the Port Barre Police Department receiving donated items from Amazon.
Facts:
The Port Barre Police Department entered into a Master Donation of Property Agreement with Amazon. Police Chief Deon R. Boudreaux stated that pursuant to the Agreement, Amazon will email his department a list of items it cannot process, ship or sell. His department then checks off those items they want. Amazon bundles those items, along with other miscellaneous items. The Police Department then goes to the Amazon shipping warehouse in Carencro and picks up the items.


Pursuant to the Agreement, the Police Department may not resell the items, but will distribute and/or use the donated property in accordance with its charitable mission.


Chief Boudreaux stated that some of the items are used by the Police Department, and some items will be used as door prizes at its Port Barre Police Department Senior Citizen luncheons or donated to a local homeless shelter, schools and churches. They also plan on giving the toys and clothing to less fortunate families and anyone they see in need.


Law:
R.S. 42:1115 prohibits a public servant from soliciting or accepting a thing of economic value from a person that has or is seeking to have a contractual, business or financial relationship with his agency.

R.S. 42:1113A prohibits a public servant, his immediate family members and legal entities in which they have an ownership interest in excess of 25% from bidding on or entering into a subcontract, contract, or other transaction that is under the supervision or jurisdiction of the public servant's agency.
