| Advisory Opinion as to whether the Code of
Governmental Ethics ("Code") would prohibit Jamie Marlbrough's daughter, JuliAnne Naquin AKA
JuliAnne David, from being rehired as a dance coach or a substitute teacher
with the Lafourche Parish School Board, while she serves as a member of the
School Board. |

Jamie Marlbrough was elected to the Lafourche Parish School Board on November 8, 2022 and
took office on January 1, 2023. Her daughter, JuliAnne
Naquin, AKA JuliAnne David, was initially employed with the Lafourche Parish School Board on
August 3, 2020, as a teacher holding a Practitioner's License. She was issued a certified teacher's license
on August 25, 2023.
On
May 22, 2023, Ms. Naquin resigned from her employment with the Lafourche Parish
School Board. Ms. Naquin seeks to be
rehired as a dance coach and/or a substitute teacher.

La.
R.S. 42:1119B provides that no
member of a governing authority shall be employed by the governmental
entity.
La.
R.S. 42:1119B(2)(a)(i) provides
that any local school board may employ any member of the immediate family of
any board member or of the superintendent as a classroom teacher provided that
such family member is certified to teach or is temporarily authorized to teach
while pursuing certification.
La. R.S. 42:1102 (11)
defines "governing authority" as the body which exercises the
legislative functions of a political subdivision.
La.
R.S. 42:1102 (12) defines "governmental
entity" as the state or any political subdivision which employs the public
employee or employed the former public employee or to which the elected
official is elected, as the case may be.
La.
R.S.42:1102 (13) defines "immediate
family" as the term relates to a public servant as his children, the
spouses of his children, his brothers and their spouses, his sisters and their
spouses, his parents, his spouse, and the parents of his spouse.
