Request for reconsideration of the assessment of the enhanced penalty pursuant to La. R.S. 18:1505.4A(4)(b) for Frank Scurlock, candidate for Mayor, City of New Orleans, in the October 14, 2017 election, for his failure to file a 2019 supplemental campaign finance disclosure report.
Facts:
At the February 2022 meeting, the Board authorized the assessment of the enhanced penalty pursuant to La. R.S. 18:1505.4A(4)(b) for Frank Scurlock, candidate for Mayor, City of New Orleans, in the October 14, 2017 election, for his failure to file a 2019 supplemental campaign finance disclosure report.

At the time of this assessment, the Board was pursuing authorization to assess an enhanced penalty against Mr. Scurlock for his failure to file his 2020 supplemental report for the same election.

On April 26, 2022, Mr. Scurlock amended his 2017 supplemental report making him no longer required to file either the 2019 or 2020 reports. Accordingly, the proceeding before the Ethics Adjudicatory Board for the 2020 report was dismissed.

The late fees for each of the 2019 and 2020 reports were rescinded, but the enhanced penalty order for the 2019 report had already been issued.

Mr. Scurlock paid the $10,000 enhanced penalty in order to qualify for the October 14, 2023 election, and is now requesting that the penalty be rescinded and that the payment be refunded. In April of 2022, Mr. Scurlock presented the Board with evidence that, despite a green card with a COVID-19 designation by the Post Office, he was at the time living in Florida and did not receive the Request for Hearing in that matter.
