Michael Morganti is employed as the Shop Supervisor by the East Baton Rouge Parish Mosquito Abatement and Rodent Control District No. 1 ("Mosquito Abatement District"). He asks whether he or his immediate family members are prohibited from purchasing surplus vehicles that were previously used in the Mosquito Abatement District. He also asks whether the prohibition includes vehicles used in other departments within East Baton Rouge Parish. Surplus vehicles are auctioned by East Baton Rouge Parish through the Municibid website.

La. R.S. 42:1113(A)(1)(a): No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
AO 2014-931: Employee of West Monroe Police Department, and his immediate family members, were prohibited from purchasing surplus property that originated from the West Monroe Police Department.
