Request
for an advisory opinion regarding whether the Code of Governmental Ethics ("Code") prohibits Jackie Marve from providing environmental consulting services and/or legal services to
the Sewerage and Water Board of New Orleans ("SWBNO"). |

Ms. Marve was employed as an attorney in various positions
with the Louisiana Department of Environmental Quality ("LDEQ") from November
1989 until her retirement on July 22, 2022. Prior to retirement, from
June 3, 2013 to July 22, 2022, she worked as a regional attorney for the
LDEQ Capital and Southeast Regional Offices. She performed duties, including
but not limited to, providing legal advice/opinions; reviewing and drafting
documents/pleadings; making appearances before the administrative tribunal and
courts of law; performing legal research; engaging in negotiations, testifying
before legal committees, and any other duties assigned. She is now considering employment as an environmental
consultant and/or attorney with SWBNO, as well as other entities associated with
the City of New Orleans.

R.S. 42:1121B(1) No former public employee shall, for a period of two years
following the termination of his public employment, assist another person, for
compensation, in a transaction, or in an appearance in connection with a
transaction in which such former public employee participated at any time
during his public employment and involving the governmental entity by which he
was formerly employed, or for a period of two years following termination of
his public employment, render, any service which such former public employee
had rendered to the agency during the term of his public employment on a
contractual basis, regardless of the parties to the contract, to, for, or on
behalf of the agency with which he was formerly employed.
