Request for an advisory opinion as to whether the Code of Governmental Ethics ("Code") prohibits Mark Becnel from doing business with Ponchatoula High School.
Facts:
Mark Becnel's company sells World's Finest Chocolate and other concession supplies to two schools in Tangipahoa Parish. His wife is a teacher at Ponchatoula High School. Recently, Mr. Becnel was asked to set up a "vendor setup form" by Ponchatoula High School. Mr. Becnel has been selling to schools in Tangipahoa Parish since 1994. He has been married to his wife since 2014. He asks whether he can sell to schools that his wife has no connection with.
Law:
La. R.S. 42:1113A provides that no public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
Recommendations:
Adopt the proposed advisory opinion.
