Request that the Board waive the $1,080.00 campaign finance late fee assessed against Tenaj "Naj" Wallace, an unsuccessful candidate for State Representative, 93rd Representative District in the February 18, 2023 election, whose 30-P campaign finance disclosure report was filed 18 days late.
Facts:
Tenaj "Naj" Wallace requests a waiver and states the following:

Due to her status as a first-time candidate who managed her own campaign, she found it overwhelming to keep up with deadlines, appearances, and questionnaires while learning the process without assistance. She had difficulty raising funds and paying this late fee would not only hinder any future campaign runs but would also harm her personal finances. Although she made efforts to stay on top of things, she was unable to access the online portal, reach the office, or navigate the website when it was time to file. Ms. Wallace believes she is now in a much better position and respectfully requests leniency regarding this matter.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
