Pam Diez is employed as the La. Department of Health ("LDH") Undersecretary over the Office of Management and Finance ("OMF"). Kerry Diez is her spouse's brother. Ms. Diez asks whether Kerry Diez is prohibited from being hired by LDH within the OMF, Bureau of Health Services Financing.

La. R.S. 42:1119A: No member of the immediate family of an agency head shall be employed in his agency.
La. R.S. 42:1102(13) defines "immediate family" to mean a public servant's children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.
