| Advisory Opinion request from Amy Casey, Executive Director of the Louisiana Motor Vehicle Commission, regarding the renewal of a sales finance license by her brother, Daniel Casey, Jr. |

On August 23, 2023,Amy Casey began her employment as the Executive Director of the Louisiana Motor Vehicle Commission (LMVC"). Her brother, Daniel Casey Jr., owns Casey Auto Sales LLC, which maintains a sales finance license with the LMVC.
The sales finance license is renewed annually by submitting a standard renewal application to the LMVC. The requirements are set by statute. LMVC staff follows a checklist of requirements, and if all are met, the license is set to be renewed without input from Ms. Casey as the Executive Director. The LMVC then ratifies the license renewals of all applicants.

La. R.S. 42:1113(A)(1)(a): No public servant, excluding any legislator and any appointed member of any board or commission and any member of a governing authority of a parish with a population of ten thousand or less, or member of such a public servant's immediate family, or legal entity in which he has a controlling interest shall bid on or enter into any contract, subcontract, or other transaction that is under the supervision or jurisdiction of the agency of such public servant.
La. R.S. 42:1112(B)(1): No public servant shall participate in a transaction involving the governmental entity in which, to his actual knowledge, any of the following persons has a substantial economic interest: Any person of which he is an officer, director, trustee, partner, or employee.
