Waiver request submitted by LaTonya S. Charles, former member of the Louisiana State Board of Social Work Examiners, regarding a $400 late fee assessed for filing her amended 2019 Tier 2.1 annual pfd 8 days late.
Facts:
LaTonya Scriven Charles stated she received a notice on 7/3/2023 (late fee order). She spoke with a BOE representative on 07/06/2023 to explain that she was unaware of the fee. She was made aware that her signature was missing from the statement, which was an oversight. It was also missing the name of the board and term of service.

It was corrected but received after the deadline due to the USPS. A copy of the NOD was attached to the LFO. She did not receive or sign for the NOD. The amended statement was received on 2/1/2023.

Ms. Charles states she that she was ill from 11/2023 - 6/2023. She had 2 surgeries during this time and was on medical leave until June. She did not intentionally file late or attempt to be out of compliance. Ms. Charles finds it disturbing that neither of the notices were signed by her or anyone in her household. She also states that the LFO was placed in her mailbox with no green card attached. She would like to ask that this fee is waived.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
