RE:
Request for an advisory opinion as to whether the spouse of the newly-appointed Adjutant General for the State of Louisiana, Brigadier General Thomas Friloux, may continue her employment with the Louisiana Military Department's Fiscal Section.
Facts:
Governor-elect Jeff Landry announced on November 29, 2023 that he was going to appoint Brigadier General Thomas Friloux to be the next Adjutant General of the State of Louisiana. General Friloux will assume that position on January 8, 2024. General Friloux's spouse, Laurie Friloux, has worked in the Military Department's Fiscal Section as an Account Technician since April 11, 2023.
Law:
La. R.S. 29:10 provides that the adjutant general "shall be appointed by the Governor with the consent of the Senate."

La. R.S. 29:11 provides for the power and duties of the adjutant general, which includes the control of the military department, subject to the orders of the governor. Furthermore, it provides that he shall have staff necessary for the operation of the department; and, that all such personnel are under the direction and control of the adjutant general.

La. R.S. 42:1119A prohibits the employment of an immediate family member of an agency head from being employed in his agency.


La. R.S. 42:1119C(2) provides an exception to allow the continued employment of an immediate family member of an agency head who was employed for more than one year prior to the person becoming the agency head.


Recommendations:
Adopt draft of advisory opinion.
