Waiver request submitted by D'Juana L. McCartney, LaSalle Parish School Board, regarding a $550 late fee assessed for filing her 2023 School Board Disclosure 11 days late.
Facts:
D'Juana L. McCartney has been a Board member in good standing for the past 12 years. A few years ago, the secretary, Ms. Gaines, began submitting disclosures for each Board member. She was told that it had been taken care of, but three weeks later, Ms. McCartney received a delinquency notice. Ms. Gaines had mistakenly submitted the 2022 statement instead of the 2023 statement. Ms. Gaines corrected the issue by submitting the 2023 statement and Ms. McCartney spoke with a BOE representative to verify that it was the correct form. This issue was a simple oversight, and Ms. McCartney would like to request that the late fee be waived.

Law:
La. R.S. 42:1119B(2)(a)(iii) by September fifteenth of each school year, any school board member or superintendent whose immediate family member is employed by the school board shall file a disclosure statement with the Board of Ethics stating the facts of such employment. Any person who fails to timely file a disclosure statement under this Item may be assessed a late fee of fifty dollars per day, not to exceed one thousand five hundred dollars, subject to the provisions of R.S. 42:1157.
Recommendations:
Suspend all but $300 based on future compliance with the Code of Ethics. The $300 is payable within 20 days and if payment is not received within 20 days, the full amount of the late fee becomes due and owing.
