Waiver request submitted by Lisa L Tropez-Arceneaux, Lycee Francais De La Nouvelle Charter School, regarding a $500 late fee assessed for filing her 2020 Tier 3 annual pfd 466 days late.
Facts:
Lisa Tropez-Arceneaux states that she did not sign the late fee notice. It was placed in her mailbox. Additionally, a representative from the BOE notified her that this was not the first attempt to deliver the notice.

Ms. Tropez-Arceneaux served as the President of the Board of Directors for Lycee Francais de Nouvelle Orleans for the past 7 years. She stated that she left the Board in October 2020 and ensured that all necessary forms were submitted before her departure. The CEO, Marina Schoen, also left and Ms. Tropez-Arceneaux was unable to access Ms. Schoen's email. However, she states that Ms. Schoen submitted all the required documentation during Ms. Tropez-Arceneaux's tenure on the Board. Ms. Tropez-Arceneaux would like to respectfully ask that the$500 late fee be waived.

*Ms. Tropez believed that her 2020 PFD was submitted on 3/1/2021. Ms. Tropez submitted an email chain between her and the school regarding the forms; however, the forms were never submitted to the board.

Law:
La. R.S. 42:1124.3 requires persons holding a public office who represent a voting district having a population of less than 5,000 and each member of the governing authority or management board of a charter school created pursuant to Chapter 42 of Title 17 of the Louisiana Revised Statutes of 1950 to file a financial disclosure statement on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.

La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
