Waiver request submitted by Thomas Houston "Tom" McVea, former member of the West Feliciana Parish Port Commission, regarding a $400 late fee assessed for filing his 2021 Tier 2.1 annual pfd 8 days late.
Facts:
Thomas McVea resigned his commission to the West Feliciana Port on 4/23/2021 and initially didn't realize that he needed to submit a disclosure. Since he is not tech-savvy, he and his wife worked together to submit the disclosure on 4/18/2023. His wife spoke to a BOE representative on 4/19/2023 and was notified that the disclosure had been received, but they might receive LFO. Mr. McVea believes that the $400 fine is excessive, especially since he resigned and is retired. During his retirement, he has spoken with friends who would like to serve their community, but after hearing about this particular situation, they have decided against it. Mr. McVea notes his appreciation and would like to ask for a waiver of the assessed late fee.

Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office. La. R.S. 42:1124.4 provides that upon discovery of the failure to file, failure to timely file, omission of information or inaccurate information, the Board shall notify the filer by sending him a notice of delinquency by certified mail. The notice of delinquency shall inform the person that the financial statement must be filed, or that the information must be disclosed or accurately disclosed, or that a written answer contesting the allegation of such failure, omission, or inaccuracy must be filed no later than seven (7) business days after receipt of the notice of delinquency.
Recommendations:
Suspend all based on future compliance with the Code of Ethics.
