RE:
Request that the Board waive the three (3) $1,000 campaign finance late fees ($3,000 total) assessed against Gary E. Johnson, a successful candidate for Councilman, District 2,City of Alexandria in the November 8, 2022 election, whose 30-P, 10-P and 10-G campaign finance disclosure reports were filed 90, 70 & 40 days late, respectively.
Facts:
Gary E. Johnson requests a waiver and states the following: Him running for office was a new experience for him and he was not fully informed of the requirements to file the necessary paperwork. Unknowingly, he misfiled the required documents with unrelated paperwork, which delayed the submission process. This was unintentional and he wouldlike to apologize. As a veteran of the U.S. Army, he understands the importance of adhering to rules and regulations. He respectfully requests that the penalty be waived and plans to be more diligent moving forward. In order to avoid this incident in the future he will be creating an online account on the Louisiana Board of Ethics' website to submit future reports.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.



LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to 30-P and 10-P, decline to waive.

With respect to 10-G, reduce to $400 based on Rule 1205C; decline to waive.
