RE:
Request that the Board waive the $240.00 campaign finance late fee assessed against Chaillie Daniel, a successful candidate for Coroner in the October 14, 2023 election, whose 30-P campaign finance disclosure report was filed 4 days late. AND Request that the Board reinstate the suspension of the $400 reassessment against Chaillie Daniel, a successful candidate for Coroner in the October 12, 2019 election, whose 30-P campaign finance disclosure report was filed 11 days late.
Facts:
Jamie Robertson, office manager for Chaillie Daniel, requests a waiver and states the following: Mr. Robertson submitted a report for the first time on 8/8/2023. He was new to the position and did not realize he needed to log in with a username and password. His misunderstanding was that when he uploaded the report, it was considered electronic. He later obtained the log-in information via e-mail and submitted the report on 9/18/2023. He would like to request a waiver of the assessed late fee, since the disclosure was submitted before the due date, just not electronically. Mr. Robertson has the correct electronic filing information and states this will not be an issue in the future.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Decline to waive; reaffirm reassessment.
