Request that the Board reconsider its decision to reduce the $3,000 to $2,000 and decline to waive campaign finance late fee assessed against Ascension Parish Republican Executive Committee, a political action committee, its committee's chairperson, Richard Carmouche, and treasurer, Alvin Bourque, whose 2022 Annual campaign finance disclosure report was filed 58 days late.

Original request stated :

The committee elected Brad Bourque as the new Secretary/Treasurer in May 2022 after the previous Secretary/Treasurer, Christina Guidry, resigned to pursue other ventures. Ms. Guidry had taken over the position when Al Robert resigned as the Chairperson in the same year. The committee also elected Richard Carmouche as the new Chairperson, Pam Alonzo as the Secretary, and Brad Bourque as Treasurer at the same time. The Secretary position was previously held by Katheryn Goppelt, who unfortunately passed away in 2022. Due to the transitional period, some deadlines were either unknown or overlooked. Although this is not an excuse, the committee would appreciate consideration for a waiver or reduction of the late fee.


Reconsideration request reiterates the same leadership transition issues and stresses that this fee would deplete the resources of the committee.

18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.
LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.
Recommendations:
Reaffirm decision to reduce to $2,000 based on Rule 1205C; decline to waive.
