Advisory opinion request concerning the Louisiana Environmental Education Commission receiving grant funding and unsolicited donations.
Facts:
The Louisiana Environmental Education Commission ("LEEC") is charged with advising and assisting the state superintendent of education, the governor, the legislature, the secretary of the Department of Environmental Quality, and other state agencies, action groups, and nature and environmental centers on policies and practices needed to provide environmental education. The Louisiana Department of Education ("LDOE") oversees the LEEC.

Diane Maygarden, on behalf of the LEEC, asked the following questions:

  • Can the LEEC apply for and receive grant funds?
  • If so, would grant applications need to be submitted through the LDOE grants approval process?
  • Would the LDOE be the recipient and manager of the grant funds?
  • Can the LEEC accept and receive grant funding?
  • What are the restrictions on the type of accounts grant funds can be housed in and where the account can reside?
  • Can awarded grant funds be housed in a third-party account, such as a Foundation account?
  • Do members of the LEEC have the authority to access funds in an LDOE account that is assigned to the LEEC?
  • Would the LDOE or the LEEC be assigned the task of managing and reporting on expenditures of awarded funds?
  • Can the LEEC receive unsolicited donations?
  • If so, what are the rules regarding donated funds?
  • Can the LEEC use donated funds to pay vendors for expenses related to hosting an annual symposium for educators?
