RE:
PFD answer filed by the members of the Louisiana Fire and Emergency Training Commission as to whether they are required to file annual PFDs pursuant to R.S. 42:1124.2.1.
Facts:
The Louisiana Fire and Emergency Training Commission was created by R.S. 40:1541. Its main purpose is to provide advice, guidance and recommendations to the Office of State Fire Marshal. According to the report published by the Office of Governor's Boards and Commissions, the commission does not have the authority to receive or expend funds. The commission is not audited by the Legislative Auditor so no report is available providing whether it has a budget.
Law:
La. R.S. 42:1124.2.1 requires financial disclosure for each member and designee of a board or commission which has the authority to expend, disburse or invest $10,000 or more of funds in a fiscal year on or before May 15th of each year during which the person holds office and the year following termination of the holding of such office.
Recommendations:
Advise the commission they are not required to file pursuant to R.S. 42:1124.2.1.
