Request that the Board waive the $2,000 campaign finance late fee assessed against Charles Christian Thomas "Chris" Guillory, a successful candidate for Assessor, Evangeline Parish, in the October 14, 2023 election, whose 30-P campaign finance disclosure report was filed 35 days late.
Facts:
Chris Guillory requests a waiver and states the following: He spoke to a BOE representative to determine if he was required to file. He was informed that he would only have to file if his expenses exceeded $2,500. Mr. Guillory states that the representative did not clarify that this rule does not apply to district candidates. He believes it should have been made clear, given the substantial fine that may be assessed to an individual if the report is not filed. He does not blame anyone for his lack of due diligence and would like to apologize for the confusion this may have caused. Mr. Guillory has children in college and as this is his first time qualifying as an incumbent, he would greatly appreciate a reduction of this late fee.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
Reduce to $600 based on Rule 1205C; decline to waive.
