RE:
Request that the Board waive the $2,500 and $400 campaign finance late fees ($2,900 total) assessed against Ronald Richard Denenea, III, a candidate for Governor, State of Louisiana, in the October 14, 2023 election, whose 180-P and 30-P campaign finance disclosure reports were filed 84 and 4 days late, respectively.
Facts:
Ronald Richard Denenea, III requests a waiver and states the following: He purchased a website domain and storage on 2/21/2023 and 2/23/2023. He held on to them because he considered running for lower office often. His report was late due to a personal expenditure, which had no specific purpose when purchased. This was his 1st time filing a report since he was not enrolled in LEADERS. After filing the 90-P timely and speaking with a BOE representative, Mr. Denenea concluded that he no longer had to file any reports since he was no longer making expenditures and hadn't received any contributions. He was later notified that he needed to continue filing. Due to this misinformation, he would like to have this matter taken into consideration. He did not intentionally violate the law and is still unsure if he must file. This fine would exceed his paycheck and total expenditures.

Law:
18:1505.4.A(1) Any candidate, the treasurer or chairman of a political committee, or any other person required to file any reports under this Chapter, who knowingly fails to file or who knowingly fails to timely file any such reports as are required by this Chapter may be assessed a civil penalty for each day until such report is filed.

LAC 52:1205(C) states if a report is filed more than 10 days late and the amount of activity on the report is less than the amount of the late fee to be assessed, the staff may reduce the late fee to the amount of activity or 10 times the per-day penalty, whichever is greater.


Recommendations:
With respect to 180-P, decline to waive.

With respect to 30-P, suspend all based on future compliance.
