Lincoln Beach was a recreation area owned by the City of New Orleans until its closure in 1965. The City of New Orleans has created the Lincoln Beach Community Advisory Committee ("Lincoln Beach Committee") within the Office of Resilience and Sustainability to provide recommendations regarding the goals and objectives for the re-establishment of Lincoln Beach as a viable, safe, and sustainable recreation location for the residents of New Orleans. The Lincoln Beach Committee is composed of seven members, two of whom who are appointed by Mayor LaToya Cantrell, two of whom who are appointed by New Orleans Council Member District E, and three other members submitted by the organization New Orleans for Lincoln Beach.
In September 2023, the City of New Orleans selected Sasaki, Inc. to develop a Master Plan for the redevelopment of Lincoln Beach. Ms. Villavaso's company, The Villavaso Group LLC, is a full-service land use planning, permitting, and business development firm. The Villavaso Group LLC has entered into a subconsultant contract with Sasaki, Inc. on this project. Ms. Villavaso asks whether The Villavaso Group LLC can contract with an appointed member of the Lincoln Beach Committee to act as a fellow on the Lincoln Beach Redevelopment Master Plan.

La. R.S. 42:1111E(1): No public servant, and no legal entity of which such public servant is an officer, director, trustee, partner, or employee, or in which such public servant has a substantial economic interest, shall receive or agree to receive any thing of economic value for assisting a person in a transaction, or in an appearance in connection with a transaction, with the agency of such public servant. La. R.S. 42:1117: No public servant or other person shall give, pay, loan, transfer, or deliver or offer to give, pay, loan, transfer, or deliver, directly or indirectly, to any public servant or other person any thing of economic value which such public servant or other person would be prohibited from receiving by any provision of this Part.
