Advisory Opinion request from Deon Boudreaux, Chief of Police for the Town of Port Barre, regarding his nephew working as an unpaid intern for the Police Department.
Facts:
Deon Boudreaux is the elected Chief of Police for the Port Barre Police Department. Chief Boudreaux's nephew, Leon Boudreaux, is participating in the Fort Johnson Career Skills Transition Program as he transitions out of his military service. As part of that program, his nephew must work as an unpaid intern at a local police agency. Chief Boudreaux asks whether his nephew can perform work for the Port Barre Police Department as an unpaid intern.
Law:
La. R.S. 42:1119B: No member of the immediate family of the chief executive of a governmental entity shall be employed by the governmental entity.
La. R.S. 42:1102 provides the following relevant definitions:
(12) "Governmental entity" means the state or any political subdivision to which the elected official is elected.
(13) "Immediate family," as the term relates to a public servant, means his children, the spouses of his children, his brothers and their spouses, his sisters and their spouses, his parents, his spouse, and the parents of his spouse.
Recommendations:
Adopt the proposed advisory opinion.
